Action in the district court for Ramsey county for a declaratory judgment that Ex. Sess. L. 1933-1934, c. 53, as amended (M.S.A. 69.54), is invalid, that an order of the state commissioner of insurance made pursuant to said act directing the collection of a surcharge of two percent of premiums on fire insurance policies for the benefit of fire department relief associations is null and void, and for certain other relief. After findings for plaintiff, Robert v. Rensch, Judge, defendant Armand W. Harris, as state commissioner of insurance, and interveners appealed from an order denying their motion for a new trial.
